1. Acceptance of Terms

By accessing or using SmartCunga, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.

2. What SmartCunga Is

SmartCunga is a cloud-based business management platform that helps small and medium enterprises track sales, expenses, inventory, customers, suppliers, and financial performance. It includes features such as receipt generation, reporting, and Mobile Money integration.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use SmartCunga for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the platform.
• Interfere with or disrupt the platform's infrastructure.
• Use the platform to generate fraudulent or misleading financial records.
• Resell or redistribute SmartCunga without written authorization.

5. Subscriptions & Payments

• SmartCunga offers free and paid subscription plans.
• Paid plans are billed according to the pricing shown at the time of purchase.
• Payments are processed via Mobile Money or other methods we support.
• Subscription fees are non-refundable unless required by Rwandan law.
• We reserve the right to change pricing with reasonable advance notice.

6. Data Ownership

You retain full ownership of all business data you enter into SmartCunga. We do not sell, share, or access your data except as necessary to provide and improve the platform. You may export your data at any time.

7. Service Availability

We strive to keep SmartCunga available at all times, but we do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice, and we will not be liable for temporary unavailability.

8. Limitation of Liability

To the maximum extent permitted by law, SmartCunga and Rwema Smart Group LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

9. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these terms. Upon termination, your data will be retained for 30 days and then permanently deleted unless you request an export.

10. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated through the platform or by email. Continued use of SmartCunga after changes take effect constitutes acceptance of the revised terms.
